Is a container classified as a structure?

Yes, a BESS container mounted on a foundation is treated as a structure and is subject to building law.

Can it be built on agricultural land?

Exclusion from agricultural use or a change of designation in the local zoning plan (MPZP) is required. For soil classes IV–VI the procedure is simpler.

What about final acceptance for use?

A notification of completion of construction is required, together with a full set of acceptance reports, including fire safety acceptance by the State Fire Service (PSP).

Short answer

An energy storage system with capacity above 300 kWh requires a building permit. For installations from 1 MWh upward, this always means the full path: compliance with the local zoning plan (MPZP) or a zoning decision, a building design, and fire safety sign-off.

When a building permit is required

Building law exempts storage systems up to 300 kWh from notification and permit requirements. All the industrial and utility-scale installations discussed on this site are above that threshold.

Spatial planning

If the site is covered by a local zoning plan (MPZP), we check whether technical infrastructure is permitted. Otherwise a zoning decision (WZ) is needed — realistically 4–8 months.

Environmental decision

Energy storage systems are generally not classified as projects that may significantly affect the environment, but for projects above 1 ha of built-up area, or when combined with a grid substation (GPZ), an environmental impact information sheet may be required.
